Felony conviction may lead to deportation

Rafael Hernandez said he wanted to come to this country because it was great and offered a great life. He now faces a situation that may result in the loss of his ability to stay in the United States. Immigration is scheduled to review his permanent residency card for possible renewal in October and it is likely that his felony conviction and sex offender status will result in the loss of that permanent residency card. 

Failure in Drug Court terminates probation

A young woman who was removed from drug court for multiple violations was in district court Tuesday, March 27 to face charges of probation violation. Rikki Lee Sanchez was convicted in 2016 of child abuse, neglect or endangerment, a gross misdemeanor. She was sentenced to 364 days in jail. The sentence was suspended and Sanchez was placed on probation with conditions. One of which required her to successfully complete Drug Court.

Defendant put on probation for drug possession

Thomas Allen Slate, an Imlay resident, pleaded guilty to one count of possession of methamphetamine. Probation is given, in most cases, for that category E felony and was the sentence in this case. Slate told Judge Michael Montero he doesn’t believe drugs are a problem for him. He promised to follow probation requirements. 

Bryce Lemonds finally sentenced

Bryce Lemonds has been in and out of district court for months. He was given probation in December on a charge of destruction of property. However, he was not released from jail after his day in court in December — as he was still facing other charges.

Local man is now a convicted felon and sex offender

Levi Alger claimed he didn’t remember the actions that resulted in charges against him for open and gross lewdness toward underage girls. However, he also said he believed the account of his actions that the girls gave law enforcement.

Probation for open and gross lewdness

A Humboldt County man who admitted to improper sexual contact with his step-daughter, when she was 13 years old, was sentenced in Senior Judge Steven Elliott’s court on Mon., March 12. Timothy Allen Draper was granted probation after pleading guilty to open and gross lewdness. Draper spent five days in jail after his arrest last year but will not spend any more time behind bars for his actions.

Would-be car thief put on probation

Nicholas Miller was arrested after he was found sitting inside a vehicle which did not belong to him. The vehicle’s owner confirmed that Miller had no business being in the vehicle and asked that charges be pressed against the 24 year-old. 

One more chance in Drug Court for Cody Potter

District Judge Michael Montero obviously struggled with whether to give Cody Potter another opportunity to succeed in Drug Court, after Potter absconded from the program and from the state for almost three months. When Potter was facing a felony conviction for possession of a controlled substance at just 20 years of age, with no criminal record, Montero gave him a chance to have that conviction diverted and to get the support and treatment available through Drug Court.
