Pershing County’s 11th Judicial convenes

On Tuesday, Jan. 21, the 11th Judicial convened at the Pershing County courthouse. They heard several cases including arraignments, sentencings and status hearings.

Pershing County man goes to prison for sex crimes

The words stuck in his throat. DA Bryce Shields was telling Judge Jim Shirley why David Lavern Tarbert deserved prison rather than probation. “This is not a probation case,” he said. The DA, a father of young children, has held the office since 2015. On Sept. 4, 2019, the court arraigned Tarbert on charges of sex assault and lewd conduct with children. The victims are Tarbert’s grandchildren, ages three, four and seven at the time of the abuse.

Pershing County men avoid habitual criminal charges

The 11th Judicial convened on Monday, Dec. 2. Outside, winter storms brewed. Hazardous driving conditions prevented a few defendants from attending their hearings, but two Pershing County men had their day in court. It was Judge Jim Shirley’s second attempt at arraigning Joel Adam Marcelja, 38. Immediately following his Nov. 4 arraignment, Marcelja tested positive for his drug of choice, methamphetamine. To protect the defendant’s rights, the court had to nullify the Nov. 4 arraignment. They’d schedule a do-over. The question was how to ensure Marcelja showed up clean and sober.  Jailing him might be the surest way. Defense Attorney Kyle Swanson and DDA Todd Banks differed on how the court should respond.

Stremler sentenced to boot camp

On Nov. 5, 2018, Pershing County’s 11th Judicial Court arraigned Cole Lewis Stremler, 24, on charges of sexual assault and statutory sexual seduction. Stremler’s alleged victim was his adopted sister, 17. On May 29, 2019, Stremler pleaded no-contest to the lesser charge of coercion, a non-sexual felony punishable by one to six years in prison. The offense is eligible for probation. The court treats a no contest plea the same as a guilty plea. This past Monday, Oct. 28, the defendant came to court for sentencing. According to court records, Mike and Barbara Stremler had three biological sons. Later, the Stremlers adopted three African American children, including the victim. The family owned and operated a ranch in Jersey Valley, a remote area of Pershing County. The children attended home school and worked cattle. The older boys hunted and trapped.
