The 11th Judicial Court met on Wednesday, Feb. 17. Judge Jim Shirley presided. Martin Garcia Rosas, 26, came to court from the Pershing County jail for a probation violation hearing. Attorney Steve Evenson represented him. Rosas’s probation officer, Chris Hohnholz, attended the hearing by telephone. Rosas admitted to a long list of violations, including testing positive for opioids on more than one occasion. According to court documents, in July 2020, Rosas entered Vitality Center in Elko, but his disrespectful and disruptive behavior led to termination from the program.

Last summer, Myrl Ray Ayer, of Grass Valley, pleaded not guilty to two counts of felony assault with a deadly weapon, an AR-15. He also faced gross misdemeanor child abuse charges for allegedly firing the gun near a minor. “I visited the crime scene a couple of times – the second time with DDA Banks,” said defense attorney Kyle Swanson. “The victim claimed a second bullet hit the ground 20 feet from him and his son. Looking at the geography of the area, where they said it happened, it looked to me like it was physically impossible.”

Years ago, Judge Jim Shirley’s sons went to school with Oscar Cruz. On Wednesday, Jan. 20, the 11th Judicial District Court sentenced Cruz to prison for three counts of arson. The defendant also faced sentencing for an unrelated felony property crime. Judge Shirley gave Cruz five to 15 years in prison for each of the three arson counts. The second count runs consecutively to the first. The third will run concurrently. His restitution comes to $1,039,395. Cruz will serve one to six years for the property crime, concurrent with count one of the arson case. In his mid-twenties, he’s looking at 10 to 30 years behind bars.

On Monday, Jan. 4, the 11th Judicial District Court met amid heightened concerns about the coronavirus and its impact on Pershing County. In the interest of clarity, Judge Jim Shirley removed his face mask once he climbed the bench. The raised platform allows for social distancing.
