Probation violations send 20-year-old to prison

Asaeh James Wolsey was sent to prison in a recent court hearing, after being given multiple chances to avoid the felony through substance abuse recovery programs. In his probation violation hearing, he asked for yet another chance at a recovery program.  Wolsey was arrested for possession of a controlled substance and later granted a diversion program, giving him the opportunity to avoid a felony conviction at 18-years of age by completing the conditions of his formal probation.  The formal probation ordered that Wolsey obtain a substance abuse evaluation and complete the recommendations of the evaluation. He later appeared in court and admitted to violating over ten of the conditions of his probation, including using controlled substances and intoxicants.  The diversion program was rescinded and Wolsey was convicted of the category E felony at 19-years-old. He was sentenced to 19-48 months in prison, the maximum sentence allowed by statute.

Man given boot camp diversion after battery by prisoner

Hawk Riverz Urban, age 22, was ordered to complete a six-month regimental discipline boot camp program as part of a diversion program to avoid a category B felony. Urban pleaded guilty to felony battery by prisoner upon a peace officer.  Urban was originally arrested on a misdemeanor public intoxication charge and later charged with two counts felony battery by prisoner upon a police officer after he struck and kicked two deputies while in custody.  Urban faced up to six years in prison for the amended battery charge for which he pleaded guilty, with eligibility for probation and the possibility of being ordered to pay restitution to any victims in the matter

Man given probation on possession for sale felony

Jose Barajas was ordered a 19-48 month suspended prison sentence on a category D felony possession of a controlled substance for sale charge in a recent Sixth Judicial District Court hearing. A felony failure to appear after admission to bail charge was dismissed pursuant to plea negotiations.  The prison sentence was suspended on the condition Barajas complete 36 months of formal probation. The formal probation advises Barajas to abstain from all alcohol or drugs and that he apply to an adult drug court program in Utah and successfully complete the program if successful.  Barajas, who is 20 years old, said he has a young child who he wants to be a successful role model for rather than leaving him to face the world alone. He asked the court to give him the chance to successfully complete probation rather than going to prison. 

Man given diversion, probation on felony drug charge

Anthony McKinney was ordered to complete the Humboldt County Drug Court program as a part of a diversion program and formal three-year probation required to avoid a felony charge.  McKinney, age 27, recently pleaded guilty to possessing both methamphetamine and heroin in Humboldt County on December 17, 2018, a category E felony charge.

Man sent to prison on battery with a deadly weapon

Dwight Alfred Anderson Jr. will serve two to five years in prison for battery with a deadly weapon, a guilty verdict returned by a jury in April. He was reported to have hit a man over the head multiple times with a ball peen hammer before trying to push an unconscious victim through a window.  During the sentencing hearing, Humboldt County Public Defender Matt Stermitz said Anderson was involved in what appeared to be a “mutual brawl” in Golconda between people who had drank way too much alcohol.  Stermitz reported that Anderson had been evaluated and is not at a high risk for reoffense, asking the court to grant his client a treatment diversion program and a term of probation rather than a prison sentence.

Woman sent to prison on drug trafficking

One of the individuals arrested in the July multi-agency drug seizure, Yude Saldana-Avila, age 33,  was sentenced to prison this week for 12-48 months on a category B felony charge of trafficking level I.  Saldana-avila pleaded guilty to the charge earlier this year, admitting to possession of 4-14 grams of cocaine, a schedule one controlled substance.  The other two individuals in the case have not been sentenced, although 23-year-old Ruben Santillan Barrera pleaded guilty to two counts of trafficking in a controlled substance level II, category B felonies which initiate a mandatory prison sentence of up to 15 years on each count, and a mandatory fine up to $100,000. Santillan Barrera is scheduled to be sentenced on October 22.  Gustavo Carrillo is facing two category A felony trafficking charges with possible life sentences and has not completed an arraignment hearing, with multiple court hearings resulting in continuances to contemplate plea negotiations.

Man sent to prison on probation violations

Carl Odoms was sent to prison to serve 12-34 months in prison on an underlying charge of possession of a controlled substance after admitting to several probation violations. Torri Hinkey and Hugo Lopez-Trujillo were given the opportunity to complete drug court and probation to avoid a felony conviction and prison in a recent court hearing.
