Nevada Supreme Court reverses marijuana scheduling decision


The Nevada Supreme Court reversed a lower court and ruled Monday that the state Board of Pharmacy can continue listing cannabis as a Schedule I drug — the same classification as heroin — despite cannabis being legal for medical and recreational purposes statewide.

In a unanimous decision, justices of the Nevada Supreme Court cited procedural issues, saying the plaintiffs lacked proper standing to challenge the classification outside of a criminal case.

The American Civil Liberties Union of Nevada represented the plaintiffs, Cannabis Equity & Inclusion Community and Antoine Poole. The latter was found guilty of possessing a controlled substance after recreational marijuana was legalized in Nevada, according to the lawsuit.

The ACLU of Nevada says that it will still pursue the issue in the future.
