March 26

In the case of Daniel Louis Smith, charged with Resisting a Public Officer – 2 Counts. Pursuant to negotiation, defendant entered a Guilty plea to Count 1 while DDA Shane Bell motioned to dismiss Count 2. 

The court canvassed his plea and accepted the same. After hearing from all parties, the court ruled as follows: Fined $1,140, which was converted to jail time and given credit for time served. 

The court accepted the DA’s motion and Count 2 has been dismissed.


In the case of Michael McLean, charged with Harassment. The county called two witnesses, the defense has no witnesses and defendant testified on his own behalf. 

It appearing to the court by evidence and testimony presented, that the defendant was guilty of Harassment. 

After hearing testimony and recommendations from the county, the court ruled as follows: Fined $1,140, which is suspended for one year on the condition of no new like violations other than minor traffic. 


March 27

In the case of Osmar Moixces Gomez, charged with Reckless Driving. Pursuant to negotiation discussed off the record, DDA Steve Girardot amended the charge to Basic Speed 20 MPH Over Limit, with the fine amount to reflect amendment. Defendant paid in full following court. 


In the case of Osmar Moixces Gomez, charged with No Proof of Insurance. Due to proof of insurance provided, DDA Steve Girardot dismissed citation.


March 28

In the case of Star Joi Penola, charged with Resisting Public Officer. Motion and order to dismiss.


In the case of David Paul Hoffman, charged with Injuring or Tampering with Vehicle. After hearing from all parties, the court ruled as follows: Fined $355, which was converted to jail time and given credit for time served. 


In the case of Gary Cressman, charged with Battery. The county offered two exhibits, which were marked and admitted w/out objection. 

After hearing recommendations from all parties, the court ruled as follows: Fined $1,140, which will be paid in monthly payments of $50, beginning June 1, 2024. Bond exonerated.


In the case of Charlie Lynn Sheppard, charged with Driving While License is Canceled, Suspended, or Revoked. Pursuant to negotiations, defendant entered a Guilty plea. 

The court canvassed his plea and accepted the same. The court ruled as follows: Fined $355, which was converted to jail time and given credit for time served.


April 2

In the case of Nicholas Ray Staas, charged with Littering. DDA Steve Girardot discussed this matter with the defendant off the record. Pursuant to negotiation, citation was dismissed.


In the case of Ralph Fredrick Virgil, charged with, 1: Trespassing, 2: Petit Larceny. After hearing from all parties, the court ruled as follows: Fined $1,335, with $1,140 converted to seven days in jail and given credit for time served. 

The remaining $195 is suspended for a period of one year on the condition of no further violations of the law other than minor traffic. Defendant is permanently trespassed from Wal-Mart. Restitution in the amount of $25.94 was ordered, to be paid in full following court. 


April 2

In the case of Jhonatan Ramirez, charged with DUI – 1st Offense. The state offered one exhibit, which was marked but not admitted, per defendant’s objection. 

The defendant entered a Guilty plea. The court canvassed his plea and accepted the same. The defendant, along with his attorney, read and signed the DUI Admonishment of Rights form which was also accepted by the court.

After hearing from all parties, the court ruled as follows: Sentenced to 30 days jail w/ 29 days stayed for a period of one year. 

Stayed jail time on the condition he serve two days, credit for time served of four hours, and 44 hours community service ordered in lieu of the remaining time, to be completed by September 1, 2024. Fined $585, to be paid by cash bail forfeiture. Online DUI school and victim impact panel completed and accepted by the court. Breath interlock device ordered for 185 days.


In the case of Harold Crawford, charged with Petit Larceny. After hearing from all parties, the court ruled as follows: Fined $1,140, which was converted to seven days jail time, and given credit for time served. No restitution ordered.


In the case of Tyler Garrett, charged with DUI – 1st Offense. The county offered one exhibit, which was marked and admitted w/out objection. 

The defendant entered a Guilty plea. The court canvassed his plea and accepted the same. 

The defendant, along with his attorney, read and signed the DUI Admonishment of Rights form, which was also accepted by the court. 

After hearing from all parties, the court ruled as follows: Sentenced to 30 days jail, with 28 days stayed for a period of one year, stayed jail time on the condition he serve two days. 

Credit of time served for one day and 24 hours of community service ordered in lieu of the remaining time to be completed by July 1, 2024. Fined $585, to be paid in full by May 1, 2024. 

Online DUI school and victim impact panel completed and accepted by the court. Breath interlock device ordered for 185 days. 

Defendant will be in town April 10, 2024 to pick up community service paperwork and pay fine.
