The 11th Judicial Court met on Monday, Mar. 7. Judge Jim Shirley presided. Sally Wilcox represented the Division of Parole and Probation. The morning proceeded briskly as the judge and attorneys considered several cases.
Christopher Wayne Quintana came to court from prison where he’s doing time for battery with substantial bodily harm.
He faced charges of breaking a window in the jury room before beginning his sentence. ‘Malicious destruction of property,’ is a gross misdemeanor, punishable by up to a year in jail and a $2,000 fine. In exchange for the guilty plea, the DA’s Office dismissed a lesser charge.
Judge Shirley determined that Quintana must pay $1,400 in restitution for what Steve Cochran referred to as “the most expensive window in Pershing County.” The defendant apologized and said it was an accident.
“When he’s completed his obligation to the State of Nevada he’ll come out with a $1,400 restitution bill and hopefully better tools to proceed with the rest of his adult life,” Cochran added. He noted several positive steps forward.
• Travis Clayton Nichols came to court from prison for a probation violation hearing. He pleaded guilty to the allegations. Kyle Swanson asked the judge to run the sentence concurrently with the Lyon County case for which Nichols is currently incarcerated.
Swanson argued that a dishonorable discharge would be a black mark on his client’s record. DDA Todd Banks argued for a dishonorable discharge, citing Nichols’ track record on probation. The judge issued the dishonorable discharge.
He also granted dishonorable discharges to Brandon Keith Small and Joseph Phillip Carroll. He honorably discharged Laura Jean Anderson.
• Daniel Nicholas Eggers, 33, came to court from jail for arraignment on charges of custodial kidnapping. He allegedly failed to deliver a child for a court-appointed visit with the mother and absconded out of state with the child. He pleaded not guilty.
Eggers faces the possibility of one to four years in prison and fines up to $10,000 for the Category B felony. He could also serve probation at the discretion of the court. The judge set the trial for May 16,17 and 18.
•The judge issued an order to transport Jeannette Irene Chamberlain from the Pershing Country jail to prison to serve her sentence for DUI, third offense. In Nov. 2021, Judge Shirley sentenced the Wyoming resident to 12-32 months in prison for violating her probation. She absconded rather than turn herself in as agreed at her sentencing hearing.?
• In 1996, a Modesto court convicted Thomas Edmon Ames, 56, of a sexual offense. He moved to Pershing County from Modesto in Sept. 2021. On Monday he pleaded guilty to failure to register as a sex offender within 48 hours after his arrival.
According to the terms of the plea agreement, Ames would serve 180 days flat time in the county jail as a condition of his probation. After he gets out of jail he would immediately update his sex offender status with law enforcement.
Judge Shirley sentences Ames on May 9. He retains sentencing discretion.
The defendant faces the possibility of one to four years in prison for the Category D felony. The crime is also punishable by probation.
• The judge continued James Trent Goodbaudy’s hearing until Mar. 21 since the attorneys indicate they are close to an agreement. Goodbaudy faces charges of intimidating a public officer, a gross misdemeanor.
The DA’s Office alleges that Goodbaudy secretly recorded and threatened the code enforcement officer during a phone call. He allegedly posted the interaction on YouTube.
