On June 15, in the case of Douglas D. Lott, charged with felony possession of a controlled substance, Chief Deputy DA Kevin Pasquale amended the criminal complaint in open court and Lott pleaded guilty to the amended charge of drugs which may not be introduced to interstate commerce. He was fined $1,140 converted to jail time and credit for time served.
In the case of Charles Edward Beavers, charged with DUI, being under the influence of a controlled substance, petit larceny, speeding, operate motor vehicle while license is suspected and/or revoked, open container: Pursuant to negotiations, the county motioned to dismiss county 1, count 5 and count 6. The defendant entered a guilty plea to county 2, no contest to count 3 and a guilty plea to count 4; fined a total of $630, credit time served for one day with a remainder of $480; defendant agreed to pay in full by cash bail forfeiture. The remaining $2,480 was refunded. The court accepted the motion to dismiss counts 1, 5 and 6. There was no restitution ordered.
On June 16, in the case of Douglas Dawayne Lott, charged with gross misdemeanor abuse of elderly person: Chief Deputy DA Kevin Pasquale was present representing the county. The defendant was present with his attorney, public defender Matt Stermitz. Due to compliance the county motioned to dismiss the charge. Defense did not oppose and the court accepted.
On June 22, in the case of Jasiel Leyva Martinez, charged with DUI 1st, driving on right required, basic speed 11-20 over, driving with license canceled/suspended: pleaded guilty to all charges and was sentenced to 90 days jail with 87 days stayed for a period of two years; stayed jail time on the condition he serve three days and was given credit for three days time served; pay a fine of $585; DUI school and victim impact panel to be completed by Sept. 21; ordered to have breath interlock installed for 36 months. Ordered to no alcohol, no controlled substances unless prescribed by a physician. No further criminal activity other than minor traffic violations. In regards to counts 2-4, no additional sanctions.
