Two men in separate gross misdemeanor cases were sentenced recently in Sixth Judicial District Court with one ordered to probation on a suspended jail sentence and another ordered to pay a fine.
Brenden Tyler Holyoak, age 26, pleaded guilty to conspiracy to commit burglary for an incident that occurred on July 30, 2020, in Winnemucca where he admitted to conspiring with someone to unlawfully enter a garage structure with the intent to commit grand larceny or petit larceny, assault or battery.
“I would like to take this time to prove to the court that I can work to be a successful, productive member of society,” said Holyoak to Sixth Judicial District Court Judge Michael Montero.
Holyoak was ordered to 364 days in jail with 100 days credit for time served. The jail time was suspended for the opportunity to complete 18 months of probation.
Holyoak was also ordered to pay a $500 public defender fee, $153 DNA collection and analysis fee and $250 administrative assessment fee.
Nathion Robert Lewis, age 44, previously pleaded guilty to one count of gross misdemeanor battery upon a peace officer from a 2017 incident.
The maximum penalty on a gross misdemeanor is 364 days in jail and a $2,000 fine, with eligibility for probation on a suspended sentence.
Humboldt County Public Defender Matthew Stermitz requested that the court give Lewis credit for time served since Lewis had just recently served time in prison and wanted to relocate back to Elko.
The court ordered 213 days credit for time served and a $1,000 fine in the matter.
