The Humboldt Sun reports all felony hearings, misdemeanor convictions and dismissals for which the court releases information. When requested by the individual, the Sun will post the person’s mug shot with their court disposition.

Sept. 9



Angel Rafael Galarza pleaded guilty to misdemeanor charges of count one: failure to immediately report accident and count two: duty to give information and render aid. On count one the court ordered a $500 fine + $140 administrative assessment and on count two a $500 fine + $140 administrative assessment with $280 suspended for two years. 



Everett Randalllee Upshaw pleaded guilty to misdemeanor injury to other property. The court ordered $415.63 restitution + $1,000 fine + $140 administrative assessment with $500 of the fines and fees suspended for two years on the condition he has no like violations of the law. 



Sept. 10

Two gross misdemeanor charges of child abuse/neglect/endangerment against Kaale Nathan Joshua Elder were dismissed on a motion by the DA’s office pursuant to plea negotiations in open court. In another case, Elder pleaded no contest to two misdemeanor breach of peace charges, amended from original charges of domestic battery. The court ordered a $375 fine + $125 administrative assessment on each count with seven days credit for time served.



A misdemeanor driving under the influence charge against Matthew Wayne Irwin was dismissed on a motion by the DA’s office in open court pursuant to statute as none of the state’s witnesses were available to appear for the hearing and defense counsel would not stipulate to a continuance. 



Andrew Sevy pleaded guilty to misdemeanor reckless driving, amended from original misdemeanor charges of driving in excess of posted speed zone 1-10 over limit and obedience to police officer. The court ordered a $750 fine + $140 administrative assessment. Sevy was ordered to serve 10 days in jail with one day credit for time served with an alternative sentence of 18 days house arrest. A victim impact panel course and 52 weeks of counseling were ordered. 



Michael Allan Callahan pleaded guilty to misdemeanor reckless driving, amended from original misdemeanor charges of driving under the influence first offense and speed 11-20 over. 

The court ordered a $500 fine + $140 administrative assessment with one day credit for time served and a victim impact panel and DUI school ordered to be completed. 



A misdemeanor disturbing the peace charge against Aurelio L. Diaz-Cisneros was dismissed on a motion by the DA’s office.
