Man ordered to pay $40,000 for destroying property

Oscar David Galarza, age 20, was recently ordered to serve 12 months of probation and pay $40,000 in restitution for destroying property. 

In the plea, Galarza admitted to injuring a brick building of another person willfully or maliciously in Humboldt County on Oct. 19, 2018, when he was just 18 years old. 

Galarza pleaded guilty to conspiracy to commit injury to or destruction of property, a gross misdemeanor in Nevada. He was originally charged with injury to or destruction of property, a category C felony prior to plea negotiations. 

The maximum sentence for a gross misdemeanor is 364 days in jail with eligibility for probation and the possibility for restitution to be ordered, which in this case it was in the amount of $40,000. 

Galarza was ordered to serve the maximum 364 days in jail on the charge, with the jail time suspended and he was placed on 12 months of probation, along with the order to pay the $40,000 restitution, $153 DNA collection and analysis fee and $25 administrative assessment fee.

Both Galarza’s attorney and the Humboldt County District Attorney agreed to the $40,000 restitution that was recommended and is to be paid within the year that he is on probation.

“When I did this action I was young, I moved out before I was 18. I was 18 when I did this and wasn’t on a very good path and the consequences of my actions I’m still dealing with it,” said Galarza. “I’ve learned enough to avoid the court systems and problems and now I just want to get this over with and continue with my life and debts and take care of the baby I had and be able to do good and make my parents proud.”
