Man ordered to probation in 2014 drug case

Earl Lamar Pointer was recently ordered to complete 36 months of probation with an underlying 12 to 32 month prison sentence from a 2014 drug case after being a fugitive from justice for over five years. 

The Nevada Department of Parole and Probation recommended that Pointer be placed on probation with a suspended sentence and reported that he had no new charges since 2014. 

Humboldt County Public Defender Matthew Stermitz told the court his client would like to put this behind him and be given credit for time served rather than prison or probation. A report indicated he had served 78 days in jail. 

Deputy District Attorney Anthony Gordon asked the court to sentence pointer to 19 to 48 months in prison with the sentence suspended and extensive probation. Gordon said Pointer was arrested with an excessive amount of marijuana on the highway in Humboldt County in 2014.

Sixth Judicial District Court Judge Michael Montero said Pointer was originally arrested for drug trafficking with 95 pounds of marijuana but was later prosecuted for drug possession, limiting the sentences that the court can impose. 

Pointer was ordered to serve 12 to 32 months in prison with 78 days time served. The prison sentence was suspended and Pointer was ordered to serve 36 months of probation in Colorado where he currently resides. 

Pointer was also ordered to pay associated fees totaling over $3,000.
