Richard Skyler Common, age 28, was ordered to serve 364 days in jail on two charges recently in Sixth Judicial District Court.
In an October hearing, Common pleaded guilty to one count of theft, a category C felony and pleaded no contest to a separate charge of gross misdemeanor conspiracy to commit grand larceny of a motor vehicle.
In the theft felony, Common admitted to controlling the property of another with the intent to deprive that person of property with a value of more than $650 but less than $3,500 in February 2020.
Humboldt County Public Defender Matthew Stermitz asked Sixth Judicial District Court Judge Michael Montero to sentence Common to 364 days in jail as a condition of probation for the felony and concurrent jail time for the gross misdemeanor charge.
“I would just like to move forward with this and get this past me,” said Common in his allocution statement to the court.
Common was ordered to 24-60 months in prison with 109 days credit for time served on the felony charge, with the prison sentence suspended and placed on 18 months of probation and 364 days in jail as a condition of the probation.
On the felony, Common was ordered to pay a $25 administrative assessment fee and $3 DNA collection fee and other standard conditions of probation, that he abstain from alcohol, controlled substances, inhalants, chemicals, liquor stores, casinos, smoke shops, vape shops, etc.
On the gross misdemeanor charge, Common was ordered to serve 364 days in jail, concurrent to the jail time on the felony. He was also ordered to pay a $1,000 fine, $3 DNA collection fee and $25 administrative assessment fee.
• In a separate court hearing, Timothy Crutcher was ordered to pay a $1,500 fine after pleading no contest to failure to update sex offender registration, a gross misdemeanor. He was also ordered to pay a $25 administrative assessment fee, $3 DNA collection fee, $250 public defender fee and have all fines and fees paid by May 1.
