Man ordered prison and probation on multiple felonies

Francis Dominic Wemple, age 27, was ordered to serve 24-60 months prison time and complete a period of probation on three felony charges. 

Wemple was arrested on November 1, 2019, on felony and gross misdemeanor possession of methamphetamine charges and felony burglary with a $20,000 bail. 

After being released from jail on those charges, he was arrested on November 12, 2019, on another felony burglary charge. 

Wemple was released earlier this year while awaiting hearings on the other cases and was arrested on a category B felony charge of stop required upon the signal of a police officer in September 2020 after failing to appear to his sentencing hearing. 

Wemple was convicted of a category C felony attempted burglary and category E possession of a controlled substance charge and his attorney Walter Fey asked the court to allow Wemple to be given a chance at probation with a substance use treatment program to help him with his addiction that is causing him to commit the crimes. 

Sixth Judicial District Court Judge Michael Montero ordered Wemple to serve 24-60 months in prison on the attempted burglary charge with 254 days credit for time served and pay a $3 DNA collection fee, $25 administrative assessment fee, $60 forensic fee and $500 public defender fee. 

On the possession of a controlled substance category E felony, the sentence was suspended and he was ordered to 18 months of probation to run concurrently with the attempted burglary sentence. 

On the category B felony stop required upon the signal of a police officer charge, Wemple was ordered to serve 24-60 months in prison with no credit for time served, to run concurrently with his other sentence and he was ordered to pay a $3 DNA collection fee, $25 administrative assessment fee and $250 public defender fee.
