Maggie Lynn Sprague, aka Maggie Crutcher, was ordered to complete one year of probation in lieu of a 364-day jail sentence on a gross misdemeanor conspiracy to commit fraud with the use of a credit or debit card charge.
Sprague, 34, pleaded guilty to conspiring with another person to use a stolen debit card without the owner’s consent at Ridley’s on Feb. 14, 2020.
Sprague and her attorney asked the court to order a fine rather than place her on probation as she is hoping to relocate out of state.
“I’m truly sorry for the victim of everything that went on and I have so much guilt, I feel bad,” said Sprague. “I wish he gets everything back or finds everything. I’m ready for a fresh start, I want to be done with this town and Nevada.”
Sprague was ordered to pay a $153 DNA collection and analysis fee, $25 administrative fee and $250 public defender fee. She was sentenced to 364 days in jail with 19 days of credit for time served.
Sixth Judicial District Court Judge Michael Montero suspended the jail sentence and ordered Sprague to complete 12 months of probation with the condition that Sprague have no contact with Winnemucca or Humboldt County and that she live elsewhere during the time of probation, per her request.
In another court hearing, Refujio Jacino-Lopez was congratulated by Montero at his sentencing hearing for completing the three-year DUI court program in lieu of a mandatory prison sentence he would have served on a DUI third offense felony charge.
Jacinto-Lopez successfully completed the program in 2019 and as a result, he was convicted of a misdemeanor DUI second offense without any other penalties, fines or jail time.
In a separate court hearing, Benjamin Phillip Petras was ordered to serve 12-30 months in prison with 74 days credit for time served on a category B battery by prisoner felony charge which he pleaded no contest to.
In accordance with a plea agreement, the court ordered that the prison sentence run concurrently with the sentence previously imposed on Petras for other charges.
The court ordered Petras to also pay a $3 DNA collection fee and $25 administrative assessment fee along with the 12-30 months in prison.
