Man sentenced to over 25 years in prison on child sex assault

Winnemucca resident Martin John Borden, age 23, was recently sent to carry out four consecutive prison sentences of seven to 20 years in prison after admitting to felony charges of attempted child sexual assault on at least four children under 14 years of age between January 2015 and August 2018 in Humboldt County. 

Borden was arrested in Winnemucca on August 27, 2018, following an investigation by the Humboldt County Sheriff’s Office and originally charged with 12 counts of child sexual assault on a child under the age of 14. 

The category A felony charges Borden originally pleaded not guilty to in his arraignment hearing included just four felony charges, two counts of sexual assault on a child under 14 and two counts of lewdness with a child under the age of 14. 

According to the Nevada Legislative Counsel Bureau, the penalty for each category A felony count of child sexual assault with a victim under 14 years of age with no substantial bodily harm is life in prison with a 35-year minimum for parole, with no probation or suspended sentence

On each category A felony count of lewdness with a child under 14 years of age, a defendant faces life in prison with a 10-year minimum for parole, no probation or suspended sentence.

The Humboldt County District Attorney later amended the case to four category B felony charges of attempted child sexual assault with a child under 14. 

After pleading guilty, Borden admitted to the court that between the specified dates, he knowingly, willfully and unlawfully attempted to subject four different children under the age of 14 to sexual penetration in Humboldt County.

Borden has been held at the Humboldt County Detention Center since his arrest with a $2.5 million dollar bail.

Borden was represented by Humboldt County Public Defender Matthew Stermitz, who asked that the court to run prison sentences concurrently if probation is not granted in the case. 

Sixth Judicial District Court Judge Michael Montero ordered the maximum sentence of 7-20 years in prison on each of the four counts, with 674 days credit for time served given in one sentence. 

Each 7-20 year sentence was ordered to run consecutive, meaning he will be in prison for at least 25 years after credit for time served is given. 

Borden was ordered to pay four counts of a $25 administrative assessment fee, $153 DNA collection and analysis fees, a $2,500 attorney fee and a $902.50 psychosexual evaluation fee.
