Daniel Corpus was not present for status hearing on fees. Steve Evenson requested 60 days to review and contact his client, who he believes is in New Mexico. “I will track him down and figure out when and how we can get $178 out of him to resolve this,” said Evenson. The judge granted Evenson 45 days. 



James Scott Kelley, an inmate of NDOC, came to court for sentencing. At an earlier hearing Kelley pleaded guilty to battery by a prisoner. He admitted to battering another inmate. 

Kenneth Ward represented Kelley. Deputy Attorney General Jason Gunnell argued on behalf of the State of Nevada. Judge Shirley sentenced the defendant to 15-48 months in prison, consecutive, with 112 days credit for time served. 



At his November 2018 arraignment, Vito Maria Schnabel pleaded guilty to possessing a controlled substance (psilocybin mushrooms) at Burning Man. On Monday he came to court for an eligibility and sentencing hearing. John Edward Oakes represented the defendant, a Manhattan art curator.

DDA Banks argued on behalf of the State of Nevada. He did not oppose Schnabel’s application for a 458 diversion program.

Judge Shirley found Schnabel eligible. He placed the defendant in the 458 program for up to 364 days and scheduled a review hearing in one year. He acknowledged the time Schnabel has spent in treatment since his arrest, but added a caveat.

“One thing we know from all the studies is, once an addict always an addict,” said the judge. “There’s always a predilection for returning to that lifestyle.”



Donald Ray Lamont Wanner came to court for arraignment on charges of possessing a stolen vehicle. Wanner, represented by PD Cochran, indicated he did not feel prepared to go forward with the hearing. To safeguard Wanner’s rights, the judge continued the arraignment until March 18, 2019.



Veronica Gonzalez pleaded guilty to an attempt to commit grand larceny, a gross misdemeanor. PD Cochran and DDA Banks recommended a sentence of 364 days in jail, suspended, with informal probation.

“The probation would last as long as it takes for restitution (of $900) to occur,” said Cochran. 

Judge Shirley ordered the DA’s Office to contact the victim. They may appear at the hearing or file a statement of how the crime impacted them (a Victim Impact Statement). 

The judge sentences Gonzalez on May 6, 2019
