Sheri McDaniel was ordered to pay restitution and complete 36 months of probation in lieu of a suspended 364-day jail sentence after pleading no contest to a 2018 charge of conspiracy to commit theft, a gross misdemeanor.
In 2018, McDaniel was arrested and charged with a category C felony theft of $1,596.19 from the Humboldt County Sheriff’s Office, in money paid to her for 39.7 overtime hours that were reported between Jan. 30 and March 12, 2017, but not actually worked. McDaniel was previously employed as a dispatch supervisor with the Sheriff’s Office.
Cory Dunckhorst with the Winnemucca Police Department investigated the case. McDaniel later signed a plea agreement, pleading no contest to a charge of conspiracy to commit theft, a gross misdemeanor.
“This is only the second arrest she (McDaniel) has had, the first one was for an insufficient funds check in 2005. I think she is going to do well on probation,” said McDaniel’s legal counsel, Humboldt County Public Defender Matthew Stermitz.
On behalf of the state, Deputy District Attorney Anthony Gordon asked the court to order probation and restitution for the amount they could prove in the case, a total of $1,596.19.
“I just want to say I appreciate everyone involved helping me with the situation and the court and all the agencies,” said McDaniel, who also reported submitting a four-page defendant statement to the court.
Based on her plea of no contest, McDaniel was found guilty of the charge and sentenced to 364 days in the Humboldt County Detention Center with credit for one day time served.
She was also ordered to pay a $153 DNA collection and analysis fee, $25 administrative assessment fee and $250 public defender fee.
The court suspended the jail sentence and placed her on probation for 36 months under standard conditions including prohibition from alcohol, controlled substances, marijuana, inhalants or chemicals, over the counter medications containing alcohol or narcotics unless prescribed, bars, liquor stores, casinos or establishments where alcohol is the primary source of revenue.
McDaniel was also ordered to pay $1,596.19 restitution.
