Theodore Emile Vallieres appeared in Sixth Judicial District Court for a sentencing hearing on May 8. After being found guilty of conspiracy to receiving, withholding or possessing stolen property, a charge which he pleaded no contest to, Vallieres was given a suspended sentenced of 364 days in the Humboldt County jail, on the condition he complete 36 months probation.
The property in question was identified as a Ruger SR22 handgun, belonging to Ace hardware.
In a statement to the court on May 8, Vallieres said he is now working full time, has purchased a car and is in the process of finding an apartment. “I can succeed on probation,” he said.
As his legal counsel, Public Defender Matthew Stermitz recommended probation for Vallieres, and prosecuting legal counsel agreed, considering Vallieres’ lack of any criminal history other than minor traffic violations.
Along with the suspended jail sentence, Vallieres was ordered to pay a fine of $500, $25 administrative assessment fee, $153 for DNA collection and analysis and $250 public defender fee. He was given credit for 84 days time served and the 364 day jail sentence was suspended, allowing Vallieres to be on probation for 36 months with special conditions ordered by the court, rather than going to jail.
Vallieres was also ordered not to enter Ridley’s while on probation.
