In a recent probation violation plea hearing, probation was revoked for Kelvin Littrell, sending him to carry out a 12-30 month prison sentence.
Littrell admitted to violating the rule of his probation in which he is not to consume, use or purchase drugs, chemicals, solvents or poisons, and this was not his first violation.
The 21-year old has been participating in the Humboldt County Drug Program for approximately two years and this is his third violation of the same type while on the program.
After a first violation of huffing, Sixth Judicial District Court Judge Michael Montero gave Littrell another chance at probation and the drug court program, considering his young age.
Littrell’s second violation in February of this year led to the diversion program being rescinded, meaning Littrell would stand convicted of the felony but still have a chance to complete his probation and drug court to avoid the 12-30 month prison sentence.
After the latest violation, Littrell appeared in court, thanked Montero, drug court and probation, and said even though he struggled on supervision, he did learn a lot.
“I learned a lot of coping skills, I excelled in employment, there’s a lot of areas which I improved just because of being on drug court and probation,” said Littrell.
Montero said there had been some time in Littrell’s time on the drug court program in which he performed very well, and that it was a bit of a roller coaster at times.
“It has been truly rewarding at times to try to provide you with services to help you and your family avoid this day, but I also at some point have to recognize when we as a system have offered you everything we can,” said Montero. “This was your third instance of being under the influence of a solvent or chemical and one while driving.”
Montero rescinded Littrell’s probation, he will carry out his 12-30 month sentence at the Nevada Department of Corrections for his original drug possession charges, with credit for time served of 110 days. He was also ordered to pay $1,345 to the drug court program.
