Pursuant to negotiations with the Humboldt County DA’s office, felony charges against Thomas Apodaca of possession of a controlled substance and being under the influence of a controlled substance were amended. The felony possession charge was amended to a misdemeanor charge of possession of a controlled substance not to be introduced into interstate commerce. The charge of being under the influence of a controlled substance was dismissed. Apodaca was sentenced to 180 days in jail with credit given for 17 days already served. The remaining 163 days were suspended for one year on conditions: 1) the defendant pay a fine of $860 + $140 AA 2) have no further violations of the law. In a separate case, Apodaca pleaded guilty to possession of drug paraphernalia. Fines and fees will run concurrent with the above case.

Sand was sentenced to 180 days in jail with credit given for 17 days already served. Felony charges against Sarah Elizabeth Dzygryniuk for possession of a controlled substance and being under the influence of a controlled substance were amended in negotiation with the Humboldt County DA’s office. The amended charge is misdemeanor possession of a controlled substance not to be introduced into interstate commerce. The charge of being under the influence was dismissed. Dzygryniuk was sentenced to180 days in jail with credit given for 17 days already served. A felony charge against Ralph Andrew Meneses of lewdness with a child under 14 was amended by the Humboldt County DA’s office to a misdemeanor charge of battery. Meneses pleaded no contest to misdemeanor battery. He was sentenced to 180 days in jail, with credit for 119 days already served. The balance of 61 days was suspended for six months on condition the defendant reimburse the county $1,500 for the cost of investigation. He was also sentenced to pay a $250 public defender fee.
July 21
Misdemeanor charges of domestic battery against Hector Havier Abrica were dismissed without prejudice after the DA’s office received a letter from Abrica’s alleged victim, saying that she lied about the incident that led to the charges.
Misdemeanor charges against Terrence John McKenzie for operating a motor vehicle while license canceled, suspended or revoked, operating an unregistered motor vehicle and operating a vehicle without evidence of insurance located within were amended by the DA’s office. The defendant provided evidence of having a driver’s license and that charge was amended to driving without a license in possession. Count two regarding no registration was dismissed. On the charge of driving without a driver’s license in possession, Mckenzie was fined $100 + $95AA. On the charge of no proof of insurance, he was fined $600 + $140 AA. Credit of $100 was given for one day jail time served.

Charges against John Allen Ridens for driving with a license that was canceled/suspended/or revoked and failure to properly display his license plate were dismissed without prejudice on a motion by the Humboldt County DA’s office. In a separate case, charges against Ridens for possession of a dangerous weapon, were also dismissed without prejudice on a motion by the HCDA’s office.
