Jose Balderas-Montero pleaded guilty to DUI-1, having an open container of alcohol in his vehicle, lane violation and driving without a valid driver’s license. He was sentenced to 30 days in jail with 28 days stayed for a year. He received credit for 12 hours served, leaving a balance of 36 hours yet to be served, or, community service in the alternative, or 72 hours of house arrest. His stayed jail time is on condition he serve the remaining 36 hours, and pay fines of $400 + $125 AA + $60 Forensic fee + $100 Special DUI Fee. The defendant is to be allowed to take an on-line DUI course, Victim Impact Panel was waived by the court. The sentences for the defendant’s other charges will run concurrent to the sentence for DUI-1. Defendant was ordered to no alcohol, no bars or drinking establishments, no controlled substances unless prescribed by a physician and to no further criminal activity other than minor traffic violations.
