Woman gets maximum sentence for battery on a police officer

WINNEMUCCA - Ashley Edith Jaramillo, 22, was given the maximum amount of time in the Humboldt County Jail for battery on a police officer.

Sixth District Judge Michael Montero sentenced her to 12 months in jail Monday on the gross misdemeanor charge.

Jaramillo was arrested in December after she was spotted by a police officer drinking at a Winnemucca establishment. The officer discovered she was on parole or probation at the time and prohibited from consuming alcohol, according to court documents. During her arrest, she shouldered a deputy and kicked at a police officer.

Public Defender Matt Stermitz said the incident in question was not harmful to the officers involved. She was in custody and intoxicated, he said.

"I don't believe it warrants 12 months in the county jail," Stermitz said.

Stermitz asked that his client be put on probation, although he acknowledged she failed a previous attempt at probation.

"I think we've got to keep working with Ms. Jaramillo," he said.

Kevin Pasquale, Humboldt County chief deputy district attorney, said she's been to jail at least three times for alcohol-related offenses and was on parole when the incident occurred.

He said Jaramillo is someone "that just doesn't get it" and urged Montero to hand down the maximum jail sentence allowed for a gross misdemeanor.

"The message that will send is you can't keep living your life like this," he said.

Jaramillo said she's been going through a lot with personal things and that has resulted in her drinking alcohol. She said she's sorry she's hurt her family.

"I am remorseful and I am ashamed," she said.

Montero said it's somewhat difficult to craft a sentence that offers both treatment and punishment.

"I'd really like to see you get some treatment," he told Jaramillo. "I hope you will take this time in custody to get clean and sober."

The sentence of one year in the county jail was ordered to run consecutive to another case.

In other cases Monday in Sixth District Court:

Justin Dean Smartt, 24, pleaded guilty to being under the influence of a controlled substance. Both sides recommended drug court. Sentencing was set for June 25.

Eric Thomas Myers, 23, pleaded no contest to possession of a controlled substance. Sentencing was set for June 25.

Nathaniel Belingheri was placed on probation for 36 months and sentenced to drug court on a charge of possession of a controlled substance.

Fernando Garza pleaded guilty to conspiracy to commit larceny from a person not amounting to robbery. Sentencing was set for June 25.

Macio Jacob Coleman, 25, pleaded guilty to conspiracy to use a controlled substance. He was sentenced to time served of 59 days.

Michael B. Elliot changed his plea of not guilty to guilty on a charge of failure by an employer to maintain industrial insurance. Sentencing was set for Sept. 10.

Eric Rehse was sentenced to 36 months of probation and ordered to apply for drug court in California. He pleaded guilty to possession of a controlled substance.

Jorge Luis Ibanez, 20, was sentenced on a gross misdemeanor charge of conspiracy to commit battery with a deadly weapon. He was sentenced to 12 months in jail, suspended, and placed on probation for 36 months. He was ordered to attend counseling and obtain a GED.
