Sexual assault of victim under 16 case bound over to district court

WINNEMUCCA - The case of Tommie L. Jones, charged with sexual assault of a victim under 16, was bound over to the Sixth Judicial District Court on Oct. 25.

Jones appeared with his attorney, Public Defender Matthew Stermitz, for a preliminary hearing before Judge Gene Wambolt in Union Township Justice Court.

Deputy District Attorney Roger Whomes called the 14-year-old female victim to testify, as well as an Elko Nevada Police Department detective who had interviewed Jones.

The incident allegedly occurred in Winnemucca on July 17 at the Model T Motel. According to court testimony, Jones had come to Winnemucca to help a relative with some task and brought his 24-year-old nephew, daughter and the alleged victim along with him. They all stayed in one motel room with two beds. After the assault was alleged to have occurred, the victim telephoned her ex-boyfriend, who reported the incident to police.

A crime lab report was produced regarding DNA evidence collected from the defendant's hands.

Wambolt ruled that sufficient evidence of a crime existed to bind the case over to district court.
