Public hearing set for March 22 for water rights ordinance

BATTLE MOUNTAIN - Lander County commissioners heard a proposal/introduction of an ordinance amending Section 17.08.100(A)(1) of the Lander County Code to change the requirement for relinquishing two acre feet of water rights for each additional parcel that is less than five acres in designated groundwater basins.

Commissioners voted unanimously Feb. 23 to uphold the recommendation of the Planning Commission and set the public hearing for the ordinance amendment for March 22.

This ordinance amends the provisions of Lander County Code 17.08.100(A)(1) to bring the requirements of this section in conformity with Nevada Revised Statutes 278.461(2). Specifically, the change will make it a requirement for any parcel map creating new parcels of less than five acres per parcel to relinquish two acre feet of water rights for each newly created parcel located in any water basin currently designated, or designated in the future as "depleted" by the Nevada Division of Water Resources.

The Planning Commission met in regular session on Dec. 14, 2011, to consider the provisions of this proposed change to Lander County Code. The Planning Commission voted unanimously to recommend approval by the Lander County Board of Commissioners of the amendment changing Lander County Code 17.08.100(A)(1).
