Preliminary hearing continued for Bill Oxley in harassment case

BATTLE MOUNTAIN - Battle Mountain resident, Bill Oxley, 48, was arraigned in the Argenta Justice Court Dec. 5 for an official charge of harassment, a second offense, stemming from a May 15 case in which he threatened to shoot and kill Mike Johnson and his family, according to the District Attorney's Office criminal complaint.

The complaint states that Oxley caused Johnson to fear for his life and the lives of his family.

A preliminary hearing that was scheduled for Dec. 20 at 1:30 p.m. in the justice court for the gross misdemeanor charge was continued to an as yet undetermined date.

According to the Lander County Sheriff's Office, Oxley was also arrested Nov. 26 for driving on a suspended/revoked driver's license.

In a separate case, Oxley was sentenced in the justice court on Oct. 19 for the official charge by the District Attorney's Office of harassment, a misdemeanor.

Judge Max Bunch sentenced him to 180 days in the Lander County jail with 150 days to be suspended for one year based on several conditions. Oxley was given credit for seven days already served and served a total of 30 days in jail before being released on Nov. 11.

The conditions of the suspended sentence were that Oxley is to have no alcohol or drugs and is subject to random testing; is not to have any contact with the victim, his family or the victim's businesses and that he must comply with a no trespass notice that was served to him; and that he is not to go onto any county property without the permission of the court unless it is for a court hearing or to see Bunch.

Oxley pleaded no contest Oct. 17 to the harassment charge. He was arrested at around 9 a.m. on Oct. 12 at his Lander County home for making terroristic threats, said Undersheriff Robert Quick.

The criminal complaint states that on or about Oct. 11, at or near 825 N. Second St., the defendant threatened to shoot Brian Garner and kill Brian Garner.

Based on a complaint made by county employees, an investigation was conducted and Oxley was arrested, said Quick. According to Quick, Oxley has a previous arrest record and is well-known to the sheriff's office.

According to Lander County Sheriff Ron Unger, Oxley's 2011 arrests include being arrested April 12 for disturbing the peace, possession of marijuana, threats and stop lights required; being arrested April 29 for unlawful possession of drug paraphernalia, possession of marijuana, no proof of insurance, tail lamps required, windshield broken and driving under the influence; being arrested May 5 for disturbing the peace, resisting a public officer, threats and being under the influence of a controlled substance; and being arrested July 29 for possession of marijuana.
