In Sixth Judicial District Court Monday the following cases were heard by Judge Michael Montero:
• Jesse William Moravec pleaded guilty to one count of grand larceny of a firearm and one count of an ex-felon in possession of a firearm. In his statement, with a quavering voice, Moravec apologized to his mother and his stepfather and asked for the mercy of the court. Chief Deputy District Attorney Kevin Pasquale said Moravec had indeed led a troubled life and had three-plus pages of a criminal history. Montero said he appreciated the openess in which Moravec spoke to the court but that his history of incarceration - 10 times, including two felony convictions - troubled him. Montero sentenced Moravec to 22 to 96 months for the first charge, and 13 to 60 months for the second charge, to run concurrently with credit for 94 days served.
• At his arraignment, Branden James Peterson entered a plea of guilty to one count of unlawful taking of a motor vehicle, a gross misdemeanor, which carries a sentence of 364 days in the Humboldt County Detention Center and a $2,000 fine. Sentencing was set for Oct. 7 at 9 a.m.
• At his arraignment, Juan Mata Ochoa entered a plea of guilty to one count of a controlled substance, a category E felony, which carries a possible sentence of one to four years in prison, a $5,000 fine and mandatory probation. Sentencing was set for Oct. 7 at 9 a.m.
• At the status hearing for Daniel Nicholas Eggers, a jury trial date was set for Jan. 7, 2015, with a pre-trial conference set for Dec. 16. On June 6, 2013, a jury found Eggers guilty of possession of a controlled substance for sale and possession of a controlled substance. On June 16, 2014, the Nevada Supreme Court reversed and remanded Eggers' conviction.
• At his arraignment, Sebastian DeVeonne Wallace pleaded guilty to possession of a controlled substance, a category E felony, which carries a possible sentence of one to four years in prison, a $5,000 fine and mandatory probation. Wallace also pleaded guilty to parole violations stemming from his arrest for possession of a controlled substance. Wallace had recently completed an 18-month drug diversion program which was rescinded as part of his plea agreement. Sentencing was set for Oct. 7 at 9 a.m.
• At the status hearing for Timothy John Lamkey, a jury trial date was set for Jan. 15, 2015. He is charged with being under the influence of a controlled substance.
• At the sentencing and eligibility hearing for Dirk D. Dykstra, the sentencing was continued until Aug. 26 at 9 a.m. He is charged with DUI third offense.
