Jacob Kiehne released from jail under house arrest Case continued to undetermined date

BATTLE MOUNTAIN - Jacob David Kiehne, 29, of Battle Mountain, was present in the Argenta Justice Court on Oct. 18 with his public defender, Ted Herrera, and the case was continued to an undetermined date.

Judge Max Bunch granted Herrera's request to release his client on his own recognizance and to place him under house arrest with conditions.

Kiehne was arrested Sept. 29 for driver disobeying a peace officer; resisting a public officer; headlamp not illuminated; driving with a revoked driver license; battery with a deadly weapon; and temporary hold.

He was charged initially by the District Attorney's Office with stop required on signal of a peace officer, a category B felony, and battery with a deadly weapon, also a category B felony.

An amended criminal complaint was submitted on Oct. 18 by the District Attorney's Office charging Kiehne with resisting a public officer with a dangerous weapon, a category D Felony.

According to the initial criminal complaint filed by the District Attorney's Office, on or near North Trescott Street, the defendant failed or refused to stop his vehicle after he was given a signal to bring his vehicle to a stop and then the defendant ran the car he was driving into and damaged the vehicle driven by Matthew Levi, a Lander County sheriff's deputy.

It also states that on or near North Trescott Street, the defendant willfully and unlawfully hit Matthew Levi with his motor vehicle, a deadly weapon.

The amended criminal complaint states that on or about Sept. 29, at or near North Trescott Street, the defendant resisted a public officer in discharging his legal duty and used a dangerous weapon, his vehicle, to resist the public officer and the defendant ran the vehicle he was driving into and damaged the vehicle driven by Matthew Levi.

According to Lander County Sheriff Ron Unger, after a vehicle pursuit at around 7:55 p.m. on Sept. 29 that started on North Second Street, deputies arrested Kiehne.

Kiehne's arraignment was held Oct. 4 in the Argenta Justice Court and he was assigned to public defender, Herrera.

According to Unger, Kiehne was allegedly driving a 1994 silver Toyota Camry with the headlights out on North Second Street the evening of Sept. 29. A deputy attempted to pull him over and Kiehne allegedly failed to yield to emergency lights and siren.

A vehicle chase ensued and Kiehne's vehicle pulled onto North Trescott Street where it made a U-turn at the dead end and then struck the deputy's vehicle, said Unger.

A foot chase took place and Kiehne was apprehended on North Reese Street and taken into custody by sheriff's deputies, said Unger.
