WINNEMUCCA - Garth Foster was sentenced on Nov. 14 for the charge of possession of a controlled substance for sale. Foster had previously entered a guilty plea agreement to the charge subsequent to the denial of his motion to suppress evidence.
Judge Michael Montero sentenced Foster to 12 to 34 months prison with 172 days credit for time served to be suspended and placed on 36 months of probation. Montero further ordered Foster to serve an additional 28 days in the Humboldt County Detention Center; not to consume, possess or purchase any alcohol or be in an establishment where alcohol is the primary source of revenue; pay an administrative assessment and forensic fee upon release; submit a biological specimen and pay a DNA fee upon release; pay $1,500 within 24 months for a public defender fee and obtain a GED or adult diploma.
Foster was remanded back to jail with a release date of Dec. 8.
