Felony drug case amended to misdemeanor charges due to math error

WINNEMUCCA - Winn Weatherly, Jr. appeared in Union Township Justice Court before Judge Edward R. Johnson on Tuesday and was sentenced on two counts of possession of drug paraphernalia.

Originally Weatherly, Jr. was charged with trafficking in a controlled substance Level I back on July 8. Law enforcement had reported that Weatherly, Jr. had 11 grams of methamphetamine in his possession but due to a misplacement of a decimal point discovered by public defender Matthew Stermitz, Weatherly, Jr.'s counsel, it really weighed 1.1 grams. Weatherly, Jr.'s case was subsequently remanded back to justice court.

Weatherly, Jr. pled no contest and was sentenced to 58 days jail with 58 days jail credit for time served for both counts to run concurrently.[[In-content Ad]]
