Deferred prosecution in theft case Kimberly Ellis' charges amended to two counts of theft

BATTLE MOUNTAIN - The preliminary hearing for Kimberly Sherrie Ellis, 30, of Battle Mountain, who was charged originally by the District Attorney's Office with two counts of uttering forged instruments, both category D felonies, was continued.

An amended criminal complaint, which was filed on Oct. 18, charges her with two counts of theft, both misdemeanors. The case was deferred for one year.

According to the initial criminal complaint, on or about June 10, at or near the Owl Club, the defendant did forge and/or alter a check belonging to (the victim) in the amount of $150. The criminal complaint also states that on or about June 12, at or near the Owl Club, the defendant did forge and/or alter a check belonging to (the victim) in the amount of $150.

In the amended criminal complaint, it states that on or about June 10, at or near the Owl Club, the defendant did control the property of (the victim) with the intent to deprive him of his property and the value of his property was $150.

According to Undersheriff Robert Quick, Ellis was not placed under arrest in Battle Mountain. According to reports, she was arrested on a felony warrant for forgery Sept. 2 in Humboldt County.

Ellis' arraignment was held Oct. 3 in the Argenta Justice Court.
