Commissioners pass resolution on Consolidated Tax Distribution Formula

BATTLE MOUNTAIN - Lander County commissioners unanimously passed at their April 12 meeting Resolution Number 2012-13, a resolution stating Lander County's position relative to the Consolidated Tax (CTX) Distribution Formula. Commissioner Brian Garner was absent.

The resolution reads as follows: whereas, Lander County is cognizant of the current distribution formula for CTX having been in place for 16 fiscal years - the longest span of any tax distribution formula since prior to the 1979 and 1981 "Tax Shift."

Whereas, Lander County supports the position of setting "Tier I" of the current CTX Distribution Formula aside from consideration for modification, and, whereas, Lander County understands the dynamics of "Tier II" of the current CTX Distribution Formula whereby the intra-county revenue allocation is established.

And, whereas, Lander County realizes no negative effects through the application of "Tier II" of the current CTX Distribution Formula, and, whereas, Lander County is aware that modifications to either "Tier I" or "Tier II" of the CTX Distribution Formula can have serious destabilizing effects, both anticipated and unanticipated, on the allocation of intra-county revenue.

Now therefore it be resolved, the Lander County Commission has established the position that "Tier I" of the current CTX Distribution Formula has worked well and continues to work well and should be set aside from consideration for modification.

And be it further resolved, the Lander Count Commission requests that deference be given to the position of Lander County and all counties within the state of Nevada experiencing no negative effects through the application of "Tier II" of the current CTX Distribution Formula.

And be it further resolved, the Lander County Commission requests the Legislative Commission's Subcommittee to Study the Allocation of Money Distributed from the Local Government Tax Distribution Account to recognize the potential destabilizing effects on the allocation of intra-county revenue that could result from substantial modifications to "Tier II" of the current CTX Distribution Formula.

And be it further resolved, the Lander County Commission requests the Legislative Commission's Subcommittee to Study the Allocation of Money Distributed from the Local Government Tax Distribution Account to exercise utmost caution in developing alternatives for modifying "Tier II" of the current CTX Distribution Formula to eliminate or minimize any negative impacts to Lander County and all other counties within the state of Nevada experiencing no negative effects through the application of "Tier II" of the current CTX Distribution Formula.
