Battle Mountain woman arrested for trafficking in a controlled substance Preliminary hearings waived, case to continue onto district court

BATTLE MOUNTAIN - Susan Elaine Tybo, of Battle Mountain, was arrested on Oct. 4 by the TRIDENT Narcotics Task Force for trafficking in a controlled substance - methamphetamine, possession of a controlled substance for sale - methamphetamine, possession of drug paraphernalia and possession of a drug without a prescription.

She was booked into the Lander County jail. As of Oct. 20, she remained in custody with her bail set at $33,637.

The District Attorney's Office charged her for three cases. One case charges her with unlawful possession of a controlled substance, a category E felony; offer, attempt or commission of an unauthorized act relating to a controlled or counterfeit substance unlawful, a category B felony; and unlawful to allow a child to be present during the commission of certain violations which involve controlled substances, a category C felony.

The criminal complaint for this case states that on or about Aug. 16, at or near 245 E. Third St. in Battle Mountain, the defendant did have in her possession methamphetamine, a controlled substance. It also states that on or about Aug. 16, at the same address, the defendant did sell approximately 4.6 grams of methamphetamine, a controlled substance.

The criminal complaint for this case also states that on or about Aug. 16, at the same residence, the defendant did sell methamphetamine, a controlled substance, while her children were present upon the premises.

The second case filed by the District Attorney's Office, charges Tybo with unlawful use or possession of drug paraphernalia, a misdemeanor. The criminal complaint states that on or about Oct. 4, at or near 245 E. Third St., No. 3, in Battle Mountain, the defendant did have in her possession items commonly used to store, contain, conceal and ingest methamphetamine.

The final case charges Tybo with unlawful possession for sale of a controlled substance, a category D felony, and possession of a dangerous drug without a prescription, a gross misdemeanor.

The criminal complaint states that on or about Oct. 4, at or near 245 E. Third St., No. 3, the defendant was in unlawful possession of methamphetamine for the purpose of sale and on or about Oct. 4, at the same residence, the defendant was in possession of a dangerous drug that was not furnished to the defendant pursuant to a legal prescription.

Tybo had one arraignment on Oct. 7 and she was assigned to public defender, Ted Herrera. Her preliminary hearing was set for Oct. 18.

On Oct. 12, Tybo had two arraignments. For one of them the preliminary hearing was set for Oct. 18. For the second case, she pleaded not guilty to unlawful use or possession of drug paraphernalia. A bench trial was scheduled for Oct. 18.

Tybo appeared in court on Oct. 18 with her public defender, Herrera, and waived both of her preliminary hearings which will now go onto district court. The bench trial is pending the outcome of what happens in the district court. Tybo is scheduled to appear in drug court on Nov. 1.

According to Sgt. Jason Franklin, of the TRIDENT Narcotics Task Force, the agency received information that Tybo was involved with the trafficking of methamphetamine from her residence.

After the completion of a longterm investigation by TRIDENT, a search warrant was obtained and was ultimately executed at her residence located in Battle Mountain.

The TRIDENT Narcotics Task Force involves members from the Humboldt County Sheriff's Office, the Winnemucca Police Department, the Lovelock Police Department, the Lander County Sheriff's Office, the Pershing County Sheriff's Office and the Nevada Department of Public Safety, Investigations Division.

Franklin said this case would not have been possible without information from the public. He further indicated additional arrests are anticipated in regard to this investigation.
