BATTLE MOUNTAIN -Ralph John Burnett, of Battle Mountain, signed an agreement on April 23, which states that he is expected to plead no contest to assault with a deadly weapon, a category B felony, at his May 21 arraignment in the Sixth Judicial District Court, according to District Attorney Angie Elquist.
In the amended criminal complaint, which was filed April 23, Burnett, 43, is accused of holding a knife to woman's face and threatening to kill her at a residence on West Antelope Drive.
He is being represented by public defender Ted Herrera.
In exchange for Burnett signing the agreement, the state will file no other charges against him, according to the no contest agreement.
Burnett faces one to six years in prison or a fine of up to $5,000 or both.
An arraignment was held March 25 in the Argenta Justice Court for Burnett, who was arrested March 20 on suspicion of multiple charges, according to the booking sheet.
In addition to assault with a deadly weapon, Burnett was also arrested on suspicion of burglary, possession of a dangerous weapon, robbery with a deadly weapon and violation of a protective order.
Prior to the amended criminal complaint, Burnett was initially charged by the district attorney's office with assault with a deadly weapon, a category B felony, burglary with possession of a deadly weapon, a category B felony, and possession of a dangerous weapon, a gross misdemeanor.
The original criminal complaint alleged that for the assault with a deadly weapon charge, Burnett held a knife to the victim's face and threatened to kill her, the same wording as in the amended criminal complaint.
It also alleged, for the burglary with possession of a deadly weapon charge, that Burnett entered the victim's residence with the intent to commit assault and possessed a deadly weapon, a knife.
Also, according to the original criminal complaint, Burnett allegedly possessed an illegal set of metal knuckles.
According to Lander County Sheriff Ron Unger, Burnett allegedly broke into the victim's home on West Antelope Drive and assaulted her on March 19 at approximately 8:30 a.m.
Unger said the woman was taken to the hospital with multiple contusions, lacerations and bruises. She was treated and released, Unger said.
Burnett is a registered felon. As of April 24, he was still in jail with his bail set at $20,000.[[In-content Ad]]
