BATTLE MOUNTAIN - John Edward Cyr, 27, of Battle Mountain, was sentenced March 26 on a charge of attempt to commit a compound crime, a category E felony, in connection with a stolen firearms case.

He was sentenced by Sixth District Court Judge Michael Montero to 12 to 32 months in prison with credit for 194 days served.

The prison sentence was suspended and Cyr was placed on probation for 36 months under several conditions, including abstaining from the purchase, possession or consumption of alcohol and that Cyr attend and complete the Lander County Drug Court program.

His sentence also consisted of a $25 administrative assessment fee, a $150 genetic testing fee and a $250 public defender fee.

He waived his preliminary hearing in the Argenta Justice Court on Nov. 20, 2012, and signed a guilty plea agreement with the Lander County District Attorney's Office.

He pleaded guilty during his district court arraignment on Jan. 20 to attempt to commit a compounding crime. In exchange for his guilty plea, the state agreed to file no other charges.

A justice court arraignment was held Sept. 6, 2012, for Cyr, who was arrested Sept. 2, 2012, in a case involving stolen firearms. At the arraignment, Cyr was assigned to public defender Ted Herrera.

Cyr was arrested on suspicion of one burglary offense and three grand larceny of a firearm offenses. He was originally officially charged by the district attorney's office with one count of burglary involving possession of a firearm, a category B felony, one count of home invasion involving possession of a firearm, a category B felony, and three counts of grand larceny of a firearm, all category B felonies.

According to Lander County Sheriff Ron Unger, the sheriff's office received a report at 9:10 p.m. on Sept. 2, 2012, that a home on Eighteenth Street had been burglarized and three weapons had been taken.

Sheriff's deputies took a report and an investigation led to the arrest of Cyr later that evening, Unger said. He was arrested at a home on Elquist Drive.

According to the criminal complaint filed Sept. 5, 2012, by the district attorney's office, for the burglary involving possession of a firearm charge, the defendant allegedly entered a home on Eighteenth Street with the intent to commit larceny and gained possession of a firearm during the commission of a crime.

The complaint also stated that for the home invasion involving possession of a firearm charge, the defendant allegedly forcibly entered the home by kicking in the door without the owners' permission and gained possession of a firearm during the commission of a crime.

For the three grand larceny of a firearm charges, the complaint alleges Cyr entered into the residence and carried away a Springfield Armory XD .45 calliber pistol, a Sig Sauer 556 rifle and a Bushmaster Varminter AR-15 rifle.[[In-content Ad]]
