After a new plea agreement offered by the prosecution was rejected by defendant James William Gentry, the suspect's case was remanded back to justice court for a preliminary hearing by Sixth Judicial Court Judge Richard Wagner during Tuesday's status/review hearing in Lovelock.
A previous plea agreement was discarded since last month's arraignment in district court with Gentry withdrawing pleas of no contest for the charges of attempted murder and assault with a deadly weapon.
This week's reversal came after information relevant to the case was presented earlier this month to Gentry's defense attorney Robert Dolan by Deputy District Attorney Bryce Shields, prosecutor in the case. Shields said the information is audio recorded by a "dash camera" mounted in a law enforcement vehicle. The camera recorded the sound of gunfire during an alleged shoot-out between Gentry and sheriff's deputies from Pershing and Humboldt Counties in Grass Valley on October 18, 2013.
The evidence in question will be considered during Gentry's upcoming preliminary hearing in Lake Township Justice Court. The case may later go before a jury in district court, Shields said on Monday.
According to the warrant of arrest affidavit, the incident occurred when deputies responded to a report of a domestic disturbance and gun shots at 1150 Anthony Road. An armed confrontation then occurred between deputies and Gentry who had reportedly been drinking. He allegedly exchanged gun fire with one Pershing County and three Humboldt County sheriff's deputies. Despite warnings to drop his weapon, Gentry pointed and fired a pistol at the deputies who returned fire according to the report. Gentry allegedly fired at least two shots at Humboldt County Sheriff's Deputy Sgt. Chris Aker and at least one shot at Pershing County Deputy Bodie Golla.
No deputies were injured during the incident and they were later cleared of any wrongdoing during a subsequent investigation by the Nevada Department of Public Safety Major Crimes Unit. Gentry, however, sustained serious injuries during the incident that required him to be hospitalized for several weeks of treatment including surgeries at Renown Medical Center according to Dolan. Following his release from the hospital, Gentry was incarcerated in the Pershing County Jail.[[In-content Ad]]
